Insolvency practitioners are officers of the Court, which carries with it an expectation that they will behave fairly and reasonably. That will extend to not being discriminatory in the way they conduct their day to day work. Discrimination can take many forms and often occurs inadvertently.

Stakeholders in insolvency cases reflect the broader general population and some will be subject to protected characteristics. A basic understanding of protected characteristics and how these may impact on the treatment of insolvency stakeholders will help them to make the necessary and proportionate adjustments to their services that the law requires.
